Terms

These are the terms for this site, the Nova app, and the coaching we sell. They are between you and NOVA Functional Training, LLC, a Colorado company.

Using the app or training with us means you accept them. If there is something here you are not comfortable with, tell us before you pay rather than after.

Train sensibly

We write programming. We are not your doctor, and nothing we publish is medical advice or treatment. If you have an injury, a condition, or any doubt at all about whether you should be training, speak to a physician first.

You are the one in the room. Warm up, use loads you can control, stop when something hurts, and do not attempt a movement you are not ready for because it appeared on a screen. Training carries risk of injury and you take that on yourself.

Coaching

One-to-one training, remote coaching and remote programming are not bought from a button. They are agreed with you directly, and they start with a minimum commitment of six months.

After those six months, either of us can end it with 30 days’ notice, given on any day — notice today ends it 30 days from today, not at the end of a calendar month. Fees are billed monthly by Stripe, and the last month is billed as normal.

The full terms are in the agreement we go through with you before anything begins, and you sign it in the app. Where it says something different from this page, the agreement you signed is the one that counts.

Fees already paid for coaching are not refunded. If something serious happens, talk to us. We look at those one at a time and we would rather find something that works than hold you to a document.

The community

Our community, its calls and events, and the courses are hosted on Skool. You join, pay and cancel there, so Skool’s own terms cover the account and the billing. It is $37 a month or $297 a year, and where a price here and the one on the join page ever differ, the one you are charged at is the one on the join page.

What is ours is the material inside it. It is for one person and is not to be shared. Use the workouts and the courses for your own training, and do not republish or resell them.

We do not refund periods that have already started, including the one you are in when you cancel. You get immediate access to everything, including material you can download and keep, which is exactly why there is nothing to give back.

The community is not coaching. Nobody is reviewing your movements individually there, and nothing in it is personalised to your history. What we publish there is general, and it is on you to judge whether it suits you.

Prices

If we change the price of something you are already paying for, you will get at least 30 days’ notice by email and the new price applies from your next renewal. You can cancel before it takes effect.

Payments are handled by Stripe, and by Skool for the community. We never see or store your card details. If a payment fails we will try again and let you know; access pauses if it keeps failing, and resumes as soon as it goes through.

Your account

Sign-in is by a link emailed to you, so keep your email secure — anyone who can read it can reach your account. Tell us straight away if you think somebody else has.

We do not work with anyone under 18 without the express written approval of their legal guardian.

What you write and upload stays yours. You give us permission to store it and to show it to you and your coach, which is the whole of what the app does with it. We will not use it for anything else without asking.

If we end it

We can close an account for non-payment, for sharing access that is meant for one person, or for behaviour towards our staff or other members that we are not willing to have here. Where it is not the last of those, we will refund the unused part of anything you have paid.

Limits

We do our best to keep the app available and the programming sound, but we cannot promise it will never be down or never contain a mistake. To the extent the law allows, our liability to you is limited to what you have paid us in the previous twelve months.

Nothing here limits liability for anything that cannot legally be limited.

Changes

If these terms change in a way that matters, we will email you rather than quietly changing the date at the top. Carrying on with us after that means you accept the new version.

Where this is governed

These terms are governed by the laws of the State of Colorado.
