Terms

These are the terms for a NOVA Functional Training membership — the monthly tiers and Lifetime access. They are between you and NOVA Functional Training, LLC, a Colorado company.

Buying a membership means you accept them. If there is something here you are not comfortable with, tell us before you pay rather than after.

Train sensibly

We write programming. We are not your doctor, and nothing in the membership is medical advice or treatment. If you have an injury, a condition, or any doubt at all about whether you should be training, speak to a physician first.

You are the one in the room. Warm up, use loads you can control, stop when something hurts, and do not attempt a movement you are not ready for because it appeared on a screen. Training carries risk of injury and you take that on yourself.

What you are buying

• $19 a month — the community, the education courses and the workout library, to follow at your own pace.
• $29 a month — all of that, plus a new workout every day, scoring, and your week the way our coached clients see it.
• $299 once — everything in the $29 tier, paid once and yours permanently, including anything we add later.

A membership is for one person and is not to be shared. Course material and workouts are ours — use them for your own training, and do not republish or resell them.

Billing and renewal

Monthly memberships renew automatically on the same date each month until you cancel. Payments are handled by Stripe; we never see or store your card details.

The $29 tier starts with a two-week free trial. We take your card at signup and charge nothing until the trial ends, and we email you three days before that happens. Cancel inside those two weeks and you are not charged at all.

If a payment fails we will try again and let you know. Access pauses if it keeps failing, and resumes as soon as it goes through.

If we change the price of a tier, you will get at least 30 days’ notice by email and the new price applies from your next renewal. You can cancel before it takes effect.

Cancelling, and refunds

Monthly memberships

Cancel any time, from Billing in your account. Cancelling stops the next payment and you keep access until the end of the period you have already paid for.

We do not refund periods that have already started, including the one you are in when you cancel. The $29 tier has a two-week free trial and a reminder three days before it ends, so you can see exactly what you are buying before you pay for it.

Lifetime

Paid once, yours permanently, and not refundable. You get immediate access to everything — the full library, every course, and whatever we add later — including material you can download and keep. That is why there is no refund window: there is nothing to give back.

If you are not sure it is for you, start on a monthly tier. Everything in it is included in Lifetime, you can cancel any time, and nothing is lost by coming to Lifetime later.

Coaching is different

One-to-one training, remote coaching and remote programming are not bought from a button. They are agreed with you directly and start with a minimum commitment of six months, after which either of us can end it with 30 days’ notice given on any day.

The full terms are in the agreement we go through with you before anything begins, and you sign it in the app. Fees already paid for coaching are not refunded — though if something serious happens, talk to us. We would rather find something that works than hold you to a document.

Your account

Sign-in is by a link emailed to you, so keep your email secure — anyone who can read it can reach your account. Tell us straight away if you think somebody else has.

What you write and upload stays yours. You give us permission to store it and to show it to you and your coach, which is the whole of what the app does with it. We will not use it for anything else without asking.

If we end it

We can close an account for non-payment, for sharing a membership, or for behaviour towards our staff or other members that we are not willing to have here. Where it is not the last of those, we will refund the unused part of anything you have paid.

Limits

We do our best to keep the app available and the programming sound, but we cannot promise it will never be down or never contain a mistake. To the extent the law allows, our liability to you is limited to what you have paid us in the previous twelve months.

Nothing here limits liability for anything that cannot legally be limited.

Changes

If these terms change in a way that matters, we will email members rather than quietly changing the date at the top. Carrying on with your membership after that means you accept the new version.

Where this is governed

These terms are governed by the laws of the State of Colorado.
